PRIVACY POLICY

Thank you for visiting our website www.cuffcph.de and for your interest in our company and our products. Despite careful review of content, we accept no liability for external links to third-party content, as we did not initiate the transmission of this information and did not select or modify the recipient of the transmitted information or the transmitted information itself.

Protecting your personal data when it is collected, processed and used during your visit to our website is important to us and takes place in accordance with the statutory provisions.

Below we explain what information we collect during your visit to our website and how it is used:

1. COLLECTION AND STORAGE OF PERSONAL DATA AND THE NATURE AND PURPOSE OF ITS USE

A) WHEN YOU VISIT THE WEBSITE

Each time a customer (or other visitor) accesses our website, the internet browser used on your device (computer, laptop, tablet, smartphone, etc.) automatically sends information to our website’s server. This information is temporarily stored in a so-called log file.

The following data is collected without any action on your part and stored until it is automatically deleted:

  • IP address of the requesting computer, as well as device ID or individual device identifier and device type,
  • name of the retrieved file and amount of data transferred, as well as date and time of access,
  • notification of successful retrieval,
  • requesting domain,
  • description of the type of internet browser used and, where applicable, the operating system of your device and the name of your access provider,
  • your browser history data and your standard web log information, location data, including location data from your mobile device. Please note that on most mobile devices you can control or disable the use of location services in the device’s settings menu.

Our legitimate interest in collecting the data pursuant to Art. 6(1)(1)(f) GDPR is based on the following purposes:

  • ensuring a smooth connection and convenient use of the website,
  • evaluating system security and stability, and
  • other administrative purposes.

Under no circumstances do we use the collected data to draw conclusions about you personally.

B) WHEN YOU USE OUR CONTACT FORM

If you have any questions, you can contact us via a form provided on the website. At a minimum, a valid email address and your name are required so that we know who the enquiry is from and can answer it. Further information can be provided voluntarily.

Data processing for the purpose of contacting us is carried out pursuant to Art. 6(1)(1)(a) GDPR on the basis of your voluntarily given consent.

The personal data we collect for the use of the contact form is automatically deleted once your enquiry has been dealt with.

C) WHEN YOU ENTER INTO A CONTRACT

When you enter into a contract on our website (e.g. registering on the website/platform or purchasing in our online shop), we ask you to provide the following personal data:

  • data that identifies you personally, such as name and email address, billing and delivery address and telephone number,
  • academic title, if applicable,
  • data that identifies your company, such as company name, address, communication data (email address, telephone and fax number) and, where applicable, VAT ID or tax number,
  • information about your payment method,
  • other personal data that we are legally obliged or entitled to collect and process and that we need for your authentication, identification or to verify the data we have collected.

This data is processed to fulfil the contract and – where necessary – passed on to the carrier commissioned with delivery. The data is processed on the basis of Art. 6(1)(b) GDPR. The storage period is limited to the purpose of the contract and, where applicable, statutory and contractual retention obligations.

D) USE OF PAYMENT SERVICE PROVIDERS

To process your order, we also work with the payment service providers listed below. As part of payment processing, we pass your payment data – solely for the purpose of the payment – to the commissioned credit institution, insofar as this is necessary for processing the payment. You can choose from the following payment service providers. The legal basis for passing on the data is Art. 6(1)(b) GDPR in each case.

E) WHEN YOU SIGN UP FOR OUR NEWSLETTER

If you have given your express consent pursuant to Art. 6(1)(1)(a) GDPR, we use your email address to send you our newsletter regularly. You can unsubscribe at any time, for example via the link at the end of each newsletter. Alternatively, you can send your unsubscribe request at any time by email to support@cuffcph.de (ideally with the subject line “Unsubscribe newsletter”).

2. DISCLOSURE OF PERSONAL DATA

Your data will not be transferred to third parties for purposes other than those listed below.

We only pass on your data to third parties if:

  • you have given your express consent (Art. 6(1)(1)(a) GDPR),
  • this is necessary to fulfil contracts with you (Art. 6(1)(b) GDPR),
  • there is a legal obligation to pass it on (Art. 6(1)(c) GDPR),
  • disclosure is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in your data not being disclosed (Art. 6(1)(1)(f) GDPR).

In these cases, however, the scope of the data transferred is limited to the necessary minimum.

Our privacy provisions comply with the applicable data protection regulations.

3. RIGHTS REGARDING YOUR PERSONAL DATA

On request, we will gladly inform you whether and which personal data about you is stored (Art. 15 GDPR), in particular about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling.

You also have the right to have any incorrect personal data corrected or incomplete data completed (Art. 16 GDPR).

Furthermore, you have the right to request that we restrict the processing of your data, provided the legal requirements for this are met (Art. 18 GDPR).

You have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format or to request its transfer to another controller (Art. 20 GDPR).

In addition, you have the so-called “right to be forgotten”, i.e. you can request that we delete your personal data, provided the legal requirements for this are met (Art. 17 GDPR).

Irrespective of this, we automatically delete your personal data if the purpose of the data collection no longer applies or the data processing was unlawful.

Pursuant to Art. 7(3) GDPR, you have the right to withdraw your consent at any time. As a result, we may no longer continue the data processing based on this consent in the future.

You also have the right to object to the processing of your personal data at any time, provided a right to object is provided for by law. In the event of an effective objection, we will also automatically delete your personal data (Art. 21 GDPR).

If you wish to exercise your right of withdrawal or objection, simply send an email to: support@cuffcph.de

In the event of breaches of data protection regulations, you have the right under Art. 77 GDPR to lodge a complaint with the competent supervisory authority in the country where you live.

4. DURATION OF DATA STORAGE

The collected data is stored for as long as is necessary to perform the contracts concluded with us, or until you exercise your right to erasure or your right to data portability to another company.

5. COOKIES

We use cookies on our website. These are small text files that your browser automatically creates and that are stored on your device when you visit our website.

The cookie stores information relating to the specific device used. However, this does not mean that we gain direct knowledge of your identity.

Firstly, cookies are used to make our website more convenient for you: we use so-called session cookies to recognise that you have already visited individual pages of our website and, if you have registered, your password is stored for the duration of your visit and while you move between pages so that you do not have to re-enter it each time, or items you have placed in your cart are saved until you “check out”. These session cookies are automatically deleted when you leave our website. In addition, to improve usability, we also use temporary cookies that are stored on your device for a specific, fixed period. If you visit our site again to use our services, it automatically recognises that you have been with us before and which entries and settings you made, so that you do not have to enter them again.

Secondly, we use cookies to statistically record and evaluate the use of our website and to optimise our offering for you. These cookies allow us to automatically recognise that you have been with us before when you visit our website again. These cookies are automatically deleted after a defined period.

The data processed by cookies is necessary for the purposes mentioned to safeguard our legitimate interests and those of third parties pursuant to Art. 6(1)(1)(f) GDPR. Most browsers accept cookies automatically. If you do not want us to recognise information about your computer, please set your internet browser to delete cookies from your hard drive, block all cookies or warn you before a cookie is stored. You can find out how to delete or block cookies in the help and support section of your internet browser. There you will also find instructions on locating the file or directory in which cookies are stored.

Please note that completely disabling cookies may mean that you cannot use all the functions of our website.

If you leave our website via a link or by clicking on a banner advertisement and reach third-party pages, cookies may also be set by the operator of the target page. We are not legally responsible for these cookies. For information on how our advertising partners use such cookies and the information stored in them, please refer to their privacy policies.

Java applets and JavaScript are used to provide our website. If, for security reasons, you do not wish to use these utilities or active content, you should disable the corresponding setting in your browser.

6. ONLINE MARKETING / ANALYTICS TOOLS

The tracking measures listed below are carried out on the basis of Art. 6(1)(1)(f) GDPR and Section 15(3) of the German Telemedia Act (TMG). With these tracking measures, we aim to ensure a needs-based design and the continuous optimisation of our website. We also use the tracking measures to statistically record the use of our website and evaluate it in order to optimise our offering for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

A) GOOGLE TAG MANAGER

Google Tag Manager is a tool that allows us to manage so-called website tags via an interface (and thus integrate e.g. Google Analytics and other marketing services into our website). The Tag Manager itself does not process any personal user data. Usage policy: https://www.google.com/intl/de/tagmanager/use-policy.html.

B) GOOGLE ANALYTICS

For the purpose of needs-based design and continuous optimisation of our website, we use Google Analytics, a web analytics service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, pseudonymised usage profiles are created and cookies (see also above) are set. The information generated by the cookie about your use of this website, such as browser type/version, operating system used, referrer URL (the previously visited page), host name of the accessing computer (IP address) and the time of the server request, is transferred to a Google server in the EU (in some cases also in the USA) and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide further services related to website and internet use for the purposes of market research and needs-based design of this website. These purposes also constitute our legitimate interest in the data processing. The legal basis for the use of Google Analytics is Art. 6(1)(f) GDPR.

This information may also be transferred to third parties if required by law or if third parties process this data on Google’s behalf. Under no circumstances will your IP address be merged with other Google data. IP addresses are anonymised so that they cannot be attributed to you (so-called IP masking).

Data sent by us and linked to cookies, user identifiers (e.g. user ID) or advertising IDs is automatically deleted after 14 months. Data whose retention period has expired is deleted automatically once a month.

Further information on the terms of use and privacy of Google Analytics can be found at http://www.google.com/analytics/terms/de.html and at http://www.google.com/intl/de/analytics/privacyoverview.html.

You can prevent the installation and storage of cookies by adjusting your browser settings accordingly; however, please note that in this case you may not be able to use all functions of this website to their full extent.

You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

Please note that completely disabling cookies may mean that you cannot use all the functions of our website.

As an alternative to the browser add-on, especially for browsers on mobile devices, you can enable anonymisation of the data collected about you. An opt-out cookie is set that anonymises the future collection of your data when you visit this website.

Anonymised web tracking on this site via Google Analytics is deactivated. Activate now

The opt-out cookie applies only to this browser and only to our website and is stored on your device. If you delete the cookies in this browser, you must set the opt-out cookie again.

C) GOOGLE ADWORDS / CONVERSION TRACKING

We also use the online advertising programme “Google AdWords” and, within Google AdWords, conversion tracking. Google Conversion Tracking is an analytics service provided by Google Inc.

When you click on an ad served by Google, a conversion tracking cookie is stored on your device. These cookies expire after 30 days, contain no personal data and are therefore not used for personal identification.

If you visit certain pages of our website and the cookie has not yet expired, Google and we can recognise that you clicked on the ad and were redirected to this page. Each Google AdWords customer receives a different cookie. Cookies therefore cannot be tracked across the websites of AdWords customers.

The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. Customers learn the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users. These purposes also constitute our legitimate interest in the data processing. The legal basis for the use of Google AdWords / Conversion Tracking is Section 15(3) TMG in conjunction with Art. 6(1)(f) GDPR.

If you do not wish to take part in tracking, you can object to this use by preventing cookies from the domain “googleadservices.com” from being installed via your browser settings. You will then not be included in the conversion tracking statistics. Further information and Google Inc.’s privacy policy can be found at: https://www.google.com/policies/technologies/ads/ , https://www.google.de/policies/privacy/.

D) GOOGLE REMARKETING

This website uses Google Remarketing, an advertising service of Google Inc. (“Google”). Third-party providers, including Google, display ads on websites across the internet. Third-party providers, including Google, use cookies to serve ads based on a user’s previous visits to this website. Users can disable Google’s use of cookies by visiting the Google ad deactivation page https://www.google.com/privacy_ads.html.

Alternatively, users can disable the use of cookies by third-party providers by visiting the Network Advertising Initiative opt-out page http://www.networkadvertising.org/managing/opt_out.asp.

7. NEWSLETTER

If you have given your express consent pursuant to Art. 6(1)(1)(a) GDPR, we use your email address to send you our newsletter regularly.

Content: We only send newsletters, emails and other electronic notifications containing promotional information (hereinafter “newsletter”) with the recipients’ consent or a legal permission.

Double opt-in and logging: Sign-up to our newsletter uses a so-called double opt-in procedure. This means that after signing up you will receive an email asking you to confirm your subscription. This confirmation is necessary so that no one can sign up using someone else’s email address. Newsletter sign-ups are logged so that the sign-up process can be proven in accordance with legal requirements. This includes storing the IP address and the time of sign-up and confirmation. Changes to your data stored with our mailing service provider are also logged.

Sign-up data: To sign up for the newsletter, it is sufficient to provide your email address. Optionally, we ask you to provide a name so that we can address you personally in the newsletter.

The newsletter is sent and its performance measured on the basis of the recipients’ consent pursuant to Art. 6(1)(a) and Art. 7 GDPR or, if consent is not required, on the basis of our legitimate interest in direct marketing pursuant to Art. 6(1)(f) GDPR.

The sign-up process is logged on the basis of our legitimate interests pursuant to Art. 6(1)(f) GDPR. Our interest is in using a user-friendly and secure newsletter system that serves our business interests, meets users’ expectations and also allows us to prove consent.

Unsubscribing/withdrawal - You can unsubscribe from our newsletter at any time, i.e. withdraw your consent. You will find a link to unsubscribe at the end of every newsletter. To be able to prove consent previously given, we store unsubscribed email addresses for up to three years on the basis of our legitimate interests before deleting them. The processing of this data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that the former existence of consent is confirmed at the same time.

A) KLAVIYO

Newsletters are sent via the mailing service provider “Klaviyo”, a newsletter platform of the US provider Klaviyo, Inc, 125 Summer Street, Boston, MA 02110, USA. You can view the mailing service provider’s privacy policy here: https://www.klaviyo.com/legal/privacy/privacy-notice. Klaviyo, Inc is certified under the Privacy Shield agreement and thereby provides a guarantee of compliance with the European level of data protection (https://bbbprograms.org/programs/all-programs/bbb-eu-privacy-shield-consumers/ProcessForConsumers).

The mailing service provider is used on the basis of our legitimate interests pursuant to Art. 6(1)(f) GDPR and a data processing agreement pursuant to Art. 28(3)(1) GDPR.

The mailing service provider may use recipients’ data in pseudonymised form, i.e. without attribution to a user, to optimise or improve its own services, e.g. for the technical optimisation of sending and displaying newsletters or for statistical purposes. However, the mailing service provider does not use our newsletter recipients’ data to contact them itself or to pass the data on to third parties.

B) NEWSLETTER - PERFORMANCE MEASUREMENT

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from our server – or, if we use a mailing service provider, from its server – when the newsletter is opened. As part of this retrieval, technical information such as information about the browser and your system, as well as your IP address and the time of retrieval, is collected.

This information is used for the technical improvement of the services based on the technical data, or to understand target groups and their reading behaviour based on their retrieval locations (which can be determined using the IP address) or access times. The statistical analysis also includes determining whether newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be attributed to individual newsletter recipients. However, it is neither our intention nor, where used, that of the mailing service provider to monitor individual users. Rather, the evaluations help us to understand the reading habits of our users and to tailor our content to them or to send different content according to our users’ interests.

Unfortunately, it is not possible to withdraw consent to performance measurement separately; in this case, the entire newsletter subscription must be cancelled.

8. SOCIAL MEDIA PLUGINS

We use social media plugins from the social networks listed below on our website.

A) FACEBOOK

Our website uses social plugins (“plugins”) of the social network facebook.com, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA (“Facebook”). When you open our website with the plugin, it establishes a direct connection to Facebook’s servers via your browser. This transmits to Facebook the information that you have visited the page.

If you are logged in to your Facebook account, clicking the plugin can link your visit to our website directly to your profile. Even if you do not have a profile, it cannot be ruled out that your IP address will be stored by Facebook.

For the purpose and scope of data collection and the further processing and use of data by Facebook, as well as your related rights and settings to protect your privacy, please refer to Facebook’s privacy notice (https://www.facebook.com/about/privacy/).

If you are a Facebook member and do not want Facebook to collect data about you via our website and link it to your member data stored with Facebook, you must log out of Facebook and delete the relevant Facebook cookies before visiting our website. It is also possible to block Facebook social plugins with browser add-ons, for example the “Facebook Blocker”.

As an alternative to the browser add-on, especially for browsers on mobile devices, you can prevent tracking by Facebook on our pages. An opt-out cookie is set that prevents the future collection of your data when you visit this website.

Web tracking for Facebook on this site is activated. Deactivate now

The opt-out cookie applies only to this browser and only to our website and is stored on your device. If you delete the cookies in this browser, you must set the opt-out cookie again.

B) INSTAGRAM

Plugins of the social network Instagram (Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA) may be integrated into our website. You can recognise the Instagram plugin by the “Instagram button” on our website. If you click the Instagram button while logged in to your Instagram account, you can link the content of our website to your Instagram profile. This allows Instagram to associate your visit to our pages with your user account.

Please note that, as the provider of this website, we have no knowledge of the content of the transmitted data or its use by Instagram. Further information can be found in Instagram’s privacy policy at https://instagram.com/about/legal/privacy/.

C) PINTEREST

Plugins of the social network Pinterest (Pinterest Inc., 808 Brannan Street San Francisco, CA 94103-490, USA) may be integrated into our website. Clicking the “Pin it” button establishes a connection to Pinterest’s servers. The plugin transmits log data to Pinterest’s server in the USA. This log data may include your IP address, the address of visited websites that also contain Pinterest features, browser type and settings, date and time of the request, how you use Pinterest, and cookies.

If you are logged in to your Pinterest account, clicking the “Pin it” button can link your visit to our website directly to your profile. Even if you do not have a profile, it cannot be ruled out that your IP address will be stored by Pinterest. This allows Pinterest to associate your visit to these pages with your user account. To prevent Pinterest from collecting data when you visit our website, you must log out of your Pinterest account before clicking the “Pin it” button.

For further information, including settings to protect your privacy, please refer to Pinterest’s privacy notice: https://about.pinterest.com/de/privacy-policy.

9. INTEGRATION OF THIRD-PARTY SERVICES AND CONTENT

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our website within the meaning of Art. 6(1)(f) GDPR), we use content or services from third-party providers on our website in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as “content”).

This always requires that the third-party providers of this content receive the users’ IP address, as they could not send the content to their browser without it. The IP address is therefore required to display this content. We endeavour to use only content whose providers use the IP address solely to deliver the content. Third-party providers may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user’s device and may include technical information about the browser and operating system, referring websites, time of visit and other information about the use of our website, and may also be combined with such information from other sources.

10. DATA SECURITY

We take all necessary technical and organisational security measures to store your personal data in such a way that it is not accessible to third parties or the public. If you wish to contact us by email, please note that the confidentiality of the information transmitted cannot be fully guaranteed via this channel. We therefore recommend that you send us confidential information by post only.

11. VALIDITY AND CHANGES TO THIS PRIVACY POLICY

Applicable law and our business practices change from time to time. When we update our Privacy Policy, we will publish the changes on our website. If we materially change the way we process your personal data, we will inform you in advance. Where required by law, we will obtain your consent before such changes are implemented. We strongly recommend that you read our Privacy Policy and keep yourself informed about our practices. This Privacy Policy was last amended in May 2018.

12. GERMAN-LANGUAGE VERSION PREVAILS

Non-German translations of this Policy are provided for convenience only. In the event of any ambiguity or conflict between translations, the German version is authoritative and prevails.

13. NAME AND CONTACT DETAILS OF THE DATA CONTROLLER
